Terms of Service

These Terms of Service (“Terms”) govern your use of the Gio mobile application operated by Gio Labs, LLC (“Gio,” “we,” “us,” or “our”). By creating an account or using Gio, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Gio. By using the app, you represent that you meet this age requirement.

2. Your Account

• You are responsible for maintaining the security of your account
• You may not impersonate another person or create misleading accounts
• You may not create multiple accounts
• We may suspend or terminate your account for violations of these Terms

3. User Content

You retain ownership of the content you post on Gio. By posting, you grant Gio a non-exclusive, worldwide, royalty-free license to display, distribute, and store your content in connection with operating the app.

You agree not to post content that:

• Is illegal, threatening, harassing, or defamatory
• Contains hate speech or discriminates against individuals or groups
• Is spam, advertising, or commercial solicitation
• Contains misinformation presented as fact
• Impersonates another person
• Violates the privacy or intellectual property rights of others
• Contains malware or malicious links

4. Community Guidelines and Moderation

• Users may report posts, replies, and profiles that violate these Terms
• Our moderation team reviews reports and may remove content or suspend accounts
• Users with 3 or more upheld reports within a 90-day period will be automatically suspended
• Suspended users may submit one appeal per suspension
• We reserve the right to remove any content or suspend any account at our sole discretion, with or without notice

5. Muting and Blocking

• You may mute other users to hide their content from your feeds
• Muting is one-directional; the muted user is not notified

6. Location Data

Gio is a location-based app. By using Gio, you consent to the collection and use of your precise location data as described in our Privacy Policy. Gio requires location access to function.

7. Intellectual Property

The Gio app, including its design, code, and branding, is owned by Gio Labs, LLC. You may not copy, modify, distribute, or reverse-engineer any part of the app.

8. Account Deletion

• You may delete your account at any time from Settings
• Account deletion requires email confirmation
• After confirmation, your content is hidden immediately
• Your data is permanently deleted after a 30-day grace period
• You may cancel the deletion during the grace period by logging back in

9. Disclaimer of Warranties

GIO IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The app will be uninterrupted or error-free
• Content posted by users is accurate, reliable, or appropriate
• The app will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GIO LABS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use Gio
• Any content posted by other users
• Unauthorized access to or alteration of your data
• Any other matter relating to Gio

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD.

11. Indemnification

You agree to indemnify and hold harmless Gio Labs, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from your use of the app or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app. Your continued use of Gio after changes are posted constitutes your acceptance of the updated Terms.
